FlatMet — Terms of Service

Welcome to FlatMet (“FlatMet”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of flatmet.com, our mobile and web services, and any tools, features, or content we make available (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree, do not access or use the Services.
Important: This document is a general template and does not constitute legal advice. Local laws may apply (including, in India, the Information Technology Act and RERA). Please consult a qualified lawyer to finalize these Terms for your business.
1) Who we are & what we do
FlatMet is a real‑estate discovery and roommate/flat‑sharing marketplace. We provide a platform where users can post and discover listings for rooms, flats, apartments, PGs, and flatmates. We are not a party to any transaction between users, and we do not own, operate, manage, or control any properties listed by users unless expressly stated.
2) Eligibility
- You must be at least 18 years old and capable of forming a binding contract under applicable law.
- If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity and that it accepts these Terms.
3) Your account
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- Provide accurate, current, and complete information. Keep it updated.
- We may (but are not obligated to) verify identities or conduct KYC for safety/fraud prevention.
4) Listings & user content
User Content includes listings, photos, videos, text, reviews, messages, and any other material you upload or transmit.
- You retain ownership of your User Content. By posting, you grant FlatMet a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, modify (for formatting/display), communicate, and display your content for operating, promoting, and improving the Services.
- You warrant that you have all rights necessary to post the content and that it does not infringe others’ rights or violate law.
- You are solely responsible for your listings’ accuracy (rent, location, amenities, availability, photos, and disclosures). Clearly disclose if you are a broker/agent and comply with local rules (e.g., RERA in India) including displaying your registration details where required.
- We may moderate, remove, or refuse content at our discretion (e.g., spam, scams, misleading, illegal, abusive, discriminatory, pornographic, or otherwise harmful content).
5) Prohibited activities (examples)
You agree not to:
- Post false, misleading, duplicate, or bait listings; engage in price gouging or undisclosed fees.
- Impersonate others; misrepresent your affiliation; harvest data; run bots/scrapers without permission.
- Upload content that infringes IP, privacy, or publicity rights; or that is defamatory, harassing, hateful, or obscene.
- Violate housing, tenancy, sub‑letting, PG/hostel rules, society by‑laws, building codes, rental caps, or municipal guidelines.
- Request or send unlawful advance payments; facilitate money laundering or any illegal activity.
- Circumvent security or access non‑public areas of the Service.
6) Payments & fees (if applicable)
- FlatMet may offer paid features (e.g., promoted listings, subscriptions, lead packs). Prices are shown in INR unless stated otherwise and may change.
- Taxes (including GST) may apply and will be charged as required by law.
- When you purchase a paid feature, you authorize us or our payment processor to charge your chosen payment method. All purchases are subject to our Refund & Cancellation Policy (if provided separately).
- FlatMet is not responsible for rent/security‑deposit transfers between users. Handle such payments directly and safely at your own risk.
7) Messaging & communications
- The Services may allow you to message other users or receive calls/notifications (including via email, SMS, WhatsApp, or in‑app).
- You agree to receive service‑related communications. You can opt out of marketing communications as described in those messages.
- You must not send spam, scams, or unlawful communications.
8) Reviews & ratings
- Reviews should be genuine, based on your experience, and must not include personal attacks or private information.
- We may remove reviews that we reasonably believe violate these Terms.
9) Third‑party services
- The Services may integrate maps, payment gateways, analytics, login providers, or other third‑party tools. FlatMet does not control and is not responsible for third‑party services. Your use of them may be governed by their own terms and privacy policies.
10) Intellectual property
- The Services (including our logos, trademarks, text, graphics, UI, and software) are owned by or licensed to FlatMet and are protected by IP laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.
- You may not use our trademarks without our prior written permission.
11) Copyright & takedowns
- If you believe that content on FlatMet infringes your copyright, please send a notice with: (a) your contact details; (b) description/URL of the infringing content; (c) proof of ownership; and (d) a statement that your claim is in good faith. Email: legal@flatmet.com.
- We may, in our discretion, remove content and/or suspend repeat infringers.
12) Privacy & data
- Our Privacy Policy explains how we collect, use, and share personal data. By using the Services, you consent to our data practices described there.
- You agree not to collect or process other users’ personal data obtained through the Services except as necessary for a legitimate transaction initiated on the platform, and you must protect such data.
13) Safety & fraud reminders
- Meet in safe, public places when possible. Verify identity and property documents. Do not share sensitive personal or financial data.
- Avoid large advance payments without proper agreements and receipts. Beware of deals that seem too good to be true.

14) Legal & regulatory disclosures (India‑specific notes)
- If you act as a real‑estate agent/broker, you are responsible for compliance with the Real Estate (Regulation and Development) Act, 2016 (“RERA”) and applicable state rules, including registration and disclosure duties.
- FlatMet acts as an intermediary/online platform and does not guarantee title, ownership, permissions, or habitability of properties listed by users.
15) Disclaimers
- The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
- We do not warrant that listings are accurate or that communications will be uninterrupted or error‑free. Use of the Services is at your sole risk.
16) Limitation of liability
To the maximum extent permitted by law, FlatMet and its directors, officers, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim shall not exceed the greater of INR 5,000 or the amount you paid to us (if any) for the Service giving rise to the claim in the 12 months preceding the event.
17) Indemnity
You agree to indemnify and hold harmless FlatMet from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another.
18) Suspension & termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect our users or the platform. You may stop using the Services at any time. Certain provisions survive termination (e.g., IP, disclaimers, limitations of liability, indemnity).
19) Changes to the Services & Terms
We are constantly improving the Services and may add, change, or remove features at any time. We may update these Terms from time to time. If changes are material, we will provide notice (e.g., by posting on the site or emailing you). The updated Terms will be effective when posted unless otherwise specified. Your continued use of the Services after the effective date constitutes acceptance.
20) Governing law & dispute resolution
These Terms are governed by the laws of India. Subject to the section below, courts at New Delhi shall have exclusive jurisdiction.
Arbitration (optional): Any dispute arising out of or relating to these Terms or the Services shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed in accordance with the Act. The seat and venue of arbitration shall be New Delhi, India. Proceedings shall be conducted in English.
